Terms and Conditions

Patriot Express Global Contract Terms and Condition: For the purpose of this document “Shipper” is defined as the person contracting for services, Patriot Express Global will be referred to as ”Patriot Express Global. “Authorized Representative” or “Designated Representative” is defined as any individual (18 years or older) which the shipper has empowered to act in his or her behalf for actions relevant to the shipment. An authorized representative is the adult person or company with possession of the bike or vehicle prior to pick up, and an adult or company which the Shipper indicates vehicle should be released to at the end of transport. “Vehicle Owner” or “Property Holder” is defined as an authorized individual at the pick up location which is the legal owner or custodian of the property. It may also mean the seller of the property if the vehicle is being transported as a result of a sale. The Shipper must have an agreement with the property holder in order for us to pick up a vehicle. Patriot Express Global does not have a legal right to the property nor accepts liability for property until it is released to our custody by the property holder, vehicle owner, authorized representative or the shipper. Patriot Express Logistics is not a “repo” service nor will act in such a capacity. The Shipper will be responsible for all cost and charges associated with this transport. The Shipper understands and agrees that should any legal action or legal collection of fees or penalties become necessary, all cases will be filed in Harris County, Houston, TX and the Shipper will be responsible for all court cost, administrative cost, and legal fees. For purposes of this document, the contract date is the date the shipment is booked with Patriot Express Logistics, and Shipper receives a booking confirmation by email confirming pickup. By making a deposit, the shipper agrees to all the terms and conditions regardless if the shipment was booked through another site and/or broker.

Legal Documentation, Shipper, Shipper’s Representative, and Authority to Contract

A. The Shipper, vehicle owner, property holder or designated representatives must be present for pick up and delivery. In the absence of the Shipper, who is contracting for the service, the designated representative, property holder or property owner, being of legal
age, will have full authority to act on behalf of the shipper for any and all actions relevant to this transport service. The Shipper, their designated agent, or property holder will assume and accept all responsibility to accept, inspection, release and provide payment for
transport.

B. The Shipper hereby swears to have the legal authority to contract a transport of said property and further swears that said property is in their legal right to control. Patriot Express Global reserves the right to demand that the Shipper or designated representative
present any legal documentation deemed necessary to establish rightful ownership and legal rights of the Shipper to possess and authorize transport of the vehicle or property.

Shipper’s Responsibility for Pick-Up and Delivery

A. The Shipper assumes the responsibility to prepare the vehicle for transport. The shipper will insure that the vehicle is readily available at the designated pick up location and is completely prepared for shipping at the designated date, time and place. The Shipper will
insure the vehicle or property is easily accessible and there is adequate space to load and unload for a 65′ truck trailer combination. No personal property will remain in/on the motorcycle. The Shipper is responsible for verifying the vehicle is free of such content. If the
Shipper is not present to release the bike, then their adult designated agent at the pick up location is responsible for all tasks related to insuring the vehicle is available and ready for shipping.
B. The Shipper will make all preparations to the motorcycle or property to prevent internal mechanical damage that could occur in the event of adverse weather conditions. Although property is transported in an enclosed trailer, Patriot Express Logistics will not be
responsible nor held liable for damage caused by freezing of engine, cooling system, batteries, or leaking fluids. Trailers are not climate controlled.
C. It will be the Shippers responsibility to remove all loose parts and accessories prior to the designated pick up date and time. External antennae, protruding parts, and all readily removable exterior components should be removed. Patriot Express Logistics is not
responsible nor liable for any part that may become unattached during loading, unloading or transport. The Shipper will be responsible and liable for damage caused to transporter’s equipment or another vehicle or property attributable to any part falling off the
Shipper’s vehicle
D. Alarm systems must be disarmed. If the alarm system utilizes a key or code, it will be provided to the driver picking up the vehicle

Pick Up & Delivery Time

A. Patriot Express Logistics will provide an estimated pick up and a delivery window, ranging in approximately five days. Although Patriot Express Logistics will make every reasonable effort to pick up and deliver at that time, it does not guarantee any exact delivery
date. Ground transport is subject to several variables outside of any carrier’s control such as traffic, weather and mechanical breakdowns. Windows, for the pick up and delivery, are best estimates made at the time of booking. The shipper will be kept informed of any
changes to their delivery or pick up window estimates. The shipper further agrees Patriot Express Logistics will not be held liable for any expenses caused by delays (i,e. rental reimbursement, time off work, copart fees, storage fees). Any exceptions to expenses
covered by Patriot Express Logistics will be communicated to the client via email in writing by an owner. Only owner can make binding contracts on behalf of Patriot Express Logistics.

B. The Shipper agrees that he or she or their designated representative will promptly meet the driver in order to affect a timely pick up and delivery at the designated location and time. Patriot Express Logistics will make every reasonable attempt to pick up and
deliver at the established time and coordinate directly with each point.

Cancellation Policy

A. All request for cancellations must be made in writing within 7 days of a scheduled pick up to avoid any fees.
B. Cancellations made en route to a pick up point will be billed at $1.00/mile already traveled. Fees may be waived by a company partner, in their sole discretion, and dependent on miles already traveled, space availability in the trailer at time of cancellation, and
ability to rebook slots.
C. Cancellations made en route to a delivery point, will be billed the entire fee agreed for transport, storage fees and a return trip. Please fully and completely negotiate all sales and moves prior to a transport pick up.
D. Buying services may be cancelled with written notice. Cancellation policies for en route shipments apply as above. Money wired for purchase will be refunded.

Damage Responsibility and Liability

A. Patriot Express Logistics will not be held responsible for any damage incurred due to vibration, shock, temperature, or water intrusion. This is applicable to ALL parts of the vehicle being transported-external and internal. It is the Shipper’s responsibility to
prepare the motorcycle and package any and all freight such that it will not be susceptible to damage when transported. Shipper should winterize the vehicle to ensure no internal damage caused by freezing fluids within the engine. While trailers can be enclosed, they
are not climate controlled. Temperature fluctuations within the trailer are caused by changes in region temperatures and should be expected with coast to coast transport.
B. The Shipper is responsible for taking appropriate action to secure and prevent damage if there are any loose parts, tears, or portions with visible wear. The Shipper agrees Patriot Express Logistics will not be held responsible or liable for damage of any fabric,
vehicle boots, caps or other canvas or material covering.
C. Exceptions for damage must be noted on the BOL at delivery or post trip inspection form (if an inspection form was used at initiation of transport). The Shipper agrees to discuss any damage claims with an owner directly.
D. The Shipper agrees that Patriot Express Logistics will not be responsible for any damage not resulting directly from transporter’s negligence nor any damage caused by factors beyond their control.
E. Patriot Express Logistics will not be held liable for windshields with stress fractures, cracks, chips or scratches which can by made worse due to temperature changes or vibration from transport

Legal Documentation, Shipper, Shipper’s Representative, and Authority to Contract

transport.

Quotes

A. The Shipper will be notified of the upcoming trip in the pick up location and delivery location with room to accommodate their shipment. These windows are not guaranteed. Patriot Express Logistics fills each trailer by a first come, first serve policy. The Shipper
will be scheduled on the first trip available to their area unless a later trip or specific time line is requested.
B. Price quotes are for specific trip dates and routes. All trips are booked on a first come, first serve basis and until a booking confirmation is sent and deposit received, slots are not reserved or guaranteed. Deposits may be waived at the sole discretion on a company.
C. Quote requests are not binding contracts to transport for either party, and not subject to any cancellation fee or notice. Multiple quote requests are welcomed.
D. The shipper agrees to fill a booking request form from the website and seize all further searches for transport once their shipment is officially booked. Space is only booked once an official email confirmation of booking is sent and a $100 non-refundable deposit is
made by the Shipper. Deposits may be waived at the sole discretion on Patriot Express Logistics.
E. The Shipper agrees to inform Patriot Express Logistics of the size of the bike being transported and any additions, such as sidecars, trailers, crash bars and bags. Additions not contracted and explicitly named at time of quote and contract may be left behind
depending upon room. IF an addition is accepted, it will be billed according to space and all fees and extra charges are assumed by the Shipper. Quotes which are made for a bike with stated extras will not incur an additional charge beyond the exact amount quoted.

 

Illegal, Hazardous, and Prohibited Materials, Substances or Contraband

A. The Shipper is responsible for and will insure no illegal, hazardous, or other prohibited materials, substances, or contraband is contained in or on any vehicle, or property consigned for shipment. Patriot Express Logistics reserves the right, at its exclusive
discretion, to perform or have performed any inspection it deems necessary to confirm the absolute absence or any such materials, substances, or contraband.
B. The Shipper understands that Patriot Express Logistics is a fully licensed and legal carrier with the Federal Motor Carrier Safety Administration and is subject to DOT check points, weight stations, and inspections. Any fees or fines assessed at such inspections
resulting from Shipper’s contraband or illegal materials will be the sole responsibility of the Shipper and due in full immediately. All identifying information and contact information will be released to the proper authorities in the event that contraband or illegal
materials are found in Shipper’s property.

Insurance

A. Patriot Express Logistics meets or exceeds the federal guidelines for liability and cargo insurance respectively in accordance with FMCSA rules and regulations.
B. Patriot Express Logistics provides $100,000 commercial cargo insurance on all shipments. Below is a general list of what is and is not covered; this is not a complete summary of the policy or everything covered within the policy. These lists are intended to give a general idea only. For a complete list of all covered extensions, exclusions, and limitations, you may request a copy of the entire insurance policy be read to you by calling the office. All insurance questions related to our policy will be directed to Patriot Express Logistics insurance agent or lawyers to ensure a full and accurate answer. Simple questions such as underwriters can be answered by the office. The Shipper has the right to request a copy of the insurance certificate directly from Patriot Express Logistics office prior to a pick up.
The Shipper may also request a copy of the insurance certificate from the insurance company.
C. It should be noted that this cargo insurance does not cover cargo loss due to a) Warlike action in time of war or peace b) weapons of war employing atomic fission or radioactive force whether in time of peace or war c) insurrection, rebellion, revolution, civil
war, usurped power, or any action authorized by a governmental authority in hindering, combating or defending against such an occurrence, seizure or destruction under quarantine or customs regulation, confiscation by order of any government or public authority,
or risk of contraband or illegal transportation or trade. d) Release or discharge or dispersal of toxic or hazardous substances, contaminants or pollutants. e) Organic pathogens or hazardous substances, f) Any loss beyond the direct physical loss to covered property. In
other words, delay, interruption of business, loss of marker value etc. g) Hail, rain, sleet or snow, whether driven by wind or not. This is why Patriot Express Logistics transports motorcycles in an enclosed trailer. h) Strikes, lock outs, labor disturbances or riots, or
civil commotions. i) Any neglect by the insured not to save or preserve the covered property at and after any loss. If damage occurs, all property should be guarded from further damage/loss.
D. It is the policy of Patriot Express Logistics to avoid adverse conditions of any kind including weather and any civil conditions which may cause harm to drivers or cargo. Decisions on weather and civil conditions are made by drivers and/or company partners.
Safety of the driver, equipment, and cargo are the first priority of Patriot Express Logistics.
E . Insurance is liable for the least of the following: a) Actual cash value of Covered Property at the point of shipment on the date of the loss. b) Insured’s legal liability under the bill of lading or shipping receipt.
c) The cost to repair, not including diminished value.
F. The Shipper understands that insurance NEVER pays “potential value” of a vehicle, what a vehicle could have been worth one day had it been restored, or fixed up. Insurance does not recognize sentimental value attached to a motorcycle. Patriot Express Logistics
will not be liable for a bike’s potential or sentimental value. It is Patriot Express Logistics policy to ship your bike right.
G. This commercial cargo insurance covers a motorcycle in transport, but not personal property contained in the vehicle including but not limited to clothing, cameras, jewelry, furs or money. Please ship the vehicle without personal items.
H. Patriot Express Logistics is not responsible nor will be held liable for any property released or in the custody of your friend, your relative, your neighbor, an interline partner, or another carrier. Your property is fully covered by our insurance once Patriot Express
Logistics accepts custody of your motorcycle, and it is in our possession. When Patriot Express Logistics releases the motorcycle to the Shipper or their designated representative, full responsibility for your property transfers to the consignee. The Shipper understands
that Patriot Express Logistics is not responsible or liable for any conditions or loss suffered once the property is released from our custody.
I. Shipper may request a copy of the insurance certificate and policy documents from the office, prior to pick up.

Payment Terms and Conditions

A. The Shipper agrees payment will be made in full in the form of cash or certified funds by delivery. Invoices must be satisfied upon receipt. Payment delays caused by the Shipper’s failure to comply with payment terms of this agreement may subject the Shipper to
additional charges.
B. Shippers wishing to pay with a credit card will can due so by calling Patriot Express Logistics prior to or at the time of delivery. All payments must be received no later than one hour prior to delivery.
C. Shippers wishing to pay via Paypal will recieve an invoice from Patriot Express Logistics. All Paypal payments must be received no later than one hour prior to delivery. The Shipper understands that Paypal charges a fee of (3.3%-4.7%) which will be added to their
invoice. Funds received by Patriot Express Logistics must satisfy the balance owed in full, so Paypal fees will be accounted for and invoiced.
D. The Shipper agrees that if payment is not made at the time of delivery, the vehicle can/ or will be stored at Shipper’s expense at a location convenient to Patriot Express Logistics route. The property will be released upon full payment at a schedule convenient to
Patriot Express Logistics but not to exceed 30 days after payment. A redelivery fee will be charged, based on location and mileage.
E. Should the Shipper be unable to accept delivery at the agreed upon time and location for any reason, the vehicle may be released to an agreed upon third party. Acceptable third parties include dealers, spouses, neighbors, friends or offspring. This third party
becomes your designated representative and should be of legal age and trustworthy. The shipper is aware that once the property is released, Patriot Express Logistics is not responsible nor liable for said property. If Shipper entrusts release of property to a mature
minor, Shipper may request pictures at time of delivery. If the Shipper entrust release of property by a mature minor, shipper understands property condition noted at pick up on BOL is accepted and agreed.
F. Quoted sum for transport is binding and not subject to change IF condition and size of the motorcycle is as stated by Shipper. Fees will be added if extra equipment, boxes or parts are added to the transport. Fees will also be added for inoperable motorcycles, not
stated as such when booking, which require extra effort, time or equipment to load. Fees will be determined by a company partner. Sidecar, trailers, bags, etc, not stated at time of booking may be left behind, depending upon room available. An additional transport
fee will be added for such items which may be equal to the sum of transporting another bike. Transport for any extra items, not included in an original quote, should be discussed prior to pick up with a company partner. Please do not add items at the pick up which
the driver is not expecting; these items will not be accepted.

Invalid Payments

A. Any form of payment the Shipper remits must be valid and immediately negotiable. A stop payment, Paypal charge back, or non negotiable funding documents will be cause for immediate referral for legal action and collection. Stop payments or cancelled
transactions will be considered an attempt to defraud Patriot Express Logistics and full legal recourse and action will be taken. The full original amount of the contract plus a 50% collection fee and all additional legal fees will be due immediately from the Shipper. B.
Full payment is due no later than by delivery. Payment is not associated with, nor dependent on any other claim the shipper may have against Patriot Express Logistics. All other claims will be processed as a separate action and does not negate payment due at delivery.

Inoperative Vehicles

A. Patriot Express Logistics accepts inoperable vehicles so long as they can be rolled on and off the trailer for shipment. The vehicle must be declared inoperative (unable to load and unload under its own power) on the Bill of Lading or in writing by Shipper.
B. The specific cause of inoperability should be explained in the inspection report, Bill of Lading or in writing by Shipper.

Delays Caused by Shipper/Their Agent at Pick Up and Delivery

A. Patriot Express Logistics is recognized for their organization and ability to work around a client’s schedule. However once a route and schedules are set it is imperative the Shipper or their designated representative adheres to the time line and not cause delays.
B. The Shipper or his/her designated representative agrees to meet Patriot Express Logistics truck at the designated location and time to affect the pick up or delivery of property being transported. Patriot Express Logistics will make every reasonable effort to notify
the pick up and delivery point at 72-48 hours prior to arrival. Then again within 12-24 hours with a more exact time.
C. Prior to pick up, the Shipper further agrees that after repeated attempts to notify the Shipper, their designated representative, or property holder by phone or email, if the carrier cannot make contact to establish a pick up, property will be left for another trip by
Patriot Express Logistics or referred to another company. The Shipper, their authorized representative, or property holder will choose which is better for their schedule and time line. If using another company, Shipper waives all fees and deposit already paid to Patriot
Express Logistics. Exceptions and refunds will be at the sole discretion of a company partner. Agreements made with other individuals or companies do not bind Patriot Express Logistics, its owners or employees. Patriot Express Logistics makes no guarantees and will
not be held liable for service, care, timeliness, insurance, compliance, or quality of equipment for any company other than Patriot Express Logistics.
D. For delivery, the Shipper further agrees that after repeated attempts to notify the Shipper or their designated representative by phone or email, if the carrier cannot make contact to establish delivery or coordinate a timely delivery, all property will be taken to a
storage facility. The shipper assumes all liablity and responsibility for vehicles which must be put in storage. All COD’s, fees, storage payments, additional redelivery and trucking fees will be the sole responsibility of the Shipper and due to Patriot Express Logistics
either in cash or certified funds before release of property may occur. Motorcycles will be stored at a storage facility within an enclosed environment (gated, garaged, or within the trailer) not in plain sight. Shops will sign for acceptance of motorcycle possession.
